Construction claims and disputes rarely emerge without prior indications. Practical experience shows that when a dispute develops, there is usually a sequence of earlier events, decisions, delayed decisions, or related circumstances that can be traced back over weeks, months, or even years and that ultimately contributed to the disagreement. These earlier circumstances are commonly understood as the “early warning signs” of construction claims and disputes.
Often, these warning signs are recognized only after claims are submitted near the end of a project, when attorneys and claims consultants begin reviewing project records and interviewing members of the project team. Looking back, many team members realize, “If only I had recognized that then!” Available research shows that there is limited published material providing a detailed listing of early warning signs that may point to future construction claims and disputes.
